BodyFlex Takes Initiative to Bring Resolution with FTC
Settlement Occurs after Federal Court rules in favor of BodyFlex
CARLSBAD, Calif., August 31, 2004
After Federal Court Judge Florence-Marie Cooper ruled in BodyFlex's favor and rejected the FTC's requests for advertising injunctions on BodyFlex, the marketers of BodyFlex took the initiative to bring final resolution with the FTC by structuring an agreement that puts customer satisfaction first. In an action to resolve outstanding issues with the FTC, the marketers of the BodyFlex system have agreed to send notifications to customers regarding an extended money back satisfaction guarantee on BodyFlex products. "BodyFlex's initiative in resolving this matter is certainly precedent setting in the industry," indicates Joseph Costa, lead counsel for Savvier, the marketers of BodyFlex. "The resolution with the FTC expressly states there has been no finding of wrong doing on the part of BodyFlex or Ms. Childers (the creator of BodyFlex), and in fact, the latest rulings by the court stated the FTC was not likely to succeed on the merits of their case.
Joseph Costa adds, "After the court rulings, BodyFlex worked together with the FTC to form an agreement for modifying the marketing claims for future advertisements, and did so even though these earlier rulings by the court indicated BodyFlex's inch loss marketing claims were not shown to be false, and the court found that the claims were sufficiently substantiated to defeat all of the relief requested by the FTC. The new agreement on the claims was designed to find a common ground between BodyFlex and the FTC on the future marketing and sale of BodyFlex products. Additionally, BodyFlex agreed to back its satisfaction guarantee with a substantial reserve account, because BodyFlex wanted to assure that if a customer is unsatisfied, then the customer will receive their money back."

Fortunately, the court saw through this and ordered the competitor to appear and disclose their involvement in filing the anti-competitive complaint, and then the court subsequently denied all of the FTC's motions. We understand the FTC's goal is protecting the consumer and we also share that goal. In the future, we hope that any concerns the FTC may have with our advertising can be resolved collaboratively, based upon the relationship we were able to establish in reaching this resolution."
